Nancy Kelly and Colin N. Holmes Publish Article on Data Breach Regulatory Enforcement and Class Actions

2/5/2014

Governo Law Firm partner Nancy Kelly and associate Colin N. Holmes recently published an article in the January-March 2014 issue of Risk & Compliance Magazine, entitled "Responses to Regulatory Enforcement and Class Actions Arising From Data Breaches: Too Little, Too Late?" The article discusses recent data breach and cybercrime lawsuits and enforcement actions and evaluates the different legal strategies companies have engaged in to combat these suits. Ms. Kelly and Mr. Holmes warn of the significant reputational and financial harm that can result from such suits, and suggest that businesses take several preventative measures, such as performing attorney-directed risk assessments, creating incident-response teams, and purchasing cyber liability insurance. They conclude that such efforts are more cost-effective than having to face government investigations, fines, and litigation in the event of a breach. You may view the article in PDF format here.
